主题:关于配合涉及种族灭绝罪、危害人类罪和战争罪的新请求
国际刑警组织(ICPO-INTERPOL)全体大会于 2010 年 11 月 8 日至 11 日在卡塔尔多哈召开第七十九届会议:
认识到将种族灭绝罪、危害人类罪和战争罪的实施者绳之以法的重要性;
回顾关于国际刑警组织与前南斯拉夫问题国际刑事法庭(ICTY)、卢旺达问题国际刑事法庭(ICTR)、塞拉利昂特别法庭及国际刑事法院开展合作的第 AGN/63/RES/9(1994)、AGN/66/RES/10(1997)、AG-2003-RES-08(2003)、AG-2004-RES-16(2004)和 AG-2007-RES-13(2007)号决议;
并回顾关于加强国际刑警组织对调查和起诉种族灭绝罪、战争罪和危害人类罪的支持的第 AG-2004-RES-17(2004)号决议;
并回顾非洲区域大会关于搜寻和缉捕 ICTR 通缉逃犯的第 2007/NCB/AFR/19ARC 号建议,以及欧洲区域大会关于搜寻和缉捕 ICTY 通缉逃犯的第 ERC-2008/REC-01 号建议;
铭记国际刑警组织《组织宪章》第 3 条,以及《为国际警务合作目的处理信息规则之实施细则》第 40 条关于在信息处理情境下解释第 3 条的规定;
关注到经由国际刑警渠道转交的、涉及种族灭绝罪、危害人类罪和战争罪的请求数量增加,这些请求在是否符合《宪章》第 3 条方面引发疑问,且成员国之间就此类请求的处理产生的争议日益增多;
鉴于上述情况决定:除适用国际刑警组织关于处理国际警务合作请求的一般规则和条例外,对涉及种族灭绝罪、危害人类罪和战争罪的新请求,应继续按以下情形经由国际刑警渠道处理:
1. 由国际法庭提交的请求;
2. 由联合国安全理事会设立的实体提交的请求,但须遵守就此类请求商定的具体安排;
3. 由成员国提交的请求,但以下情形除外:该请求涉及另一成员国的国民,且该另一成员国在总秘书处通知其该请求后三十日内提出反对;
鼓励所有成员国继续合作,特别是利用国际刑警渠道,依照国际刑警组织规则和本决议,调查和起诉种族灭绝罪、危害人类罪和战争罪的实施者;
请总秘书处依照本决议继续提供协助,并就该领域请求的处理建立相关程序。

AG-2010-RES-10 — RESOLUTION
Subject: Co-operation with new requests concerning genocide, crimes against humanity and war crimes
The ICPO-INTERPOL General Assembly, meeting in Doha, Qatar, from 8 to 11 November 2010 at its 79th session:
COGNIZANT of the importance of bringing perpetrators of genocide, crimes against humanity and war crimes to justice,
RECALLING Resolutions AGN/63/RES/9 (1994), AGN/66/RES/10 (1997), AG-2003-RES-08 (2003), AG-2004-RES-16 (2004), and AG-2007-RES-13 (2007) concerning the co-operation of INTERPOL with the International Criminal Tribunal for the former Yugoslavia (ICTY), the International Criminal Tribunal for Rwanda (ICTR), the Special Court for Sierra Leone, and the International Criminal Court,
ALSO RECALLING Resolution AG-2004-RES-17 (2004) on increased INTERPOL support for the investigation and prosecution of genocide, war crimes and crimes against humanity,
ALSO RECALLING Recommendation 2007/NCB/AFR/19ARC of the African Regional Conference on searching for and apprehending fugitives wanted by the ICTR, and Recommendation ERC-2008/REC-01 of the European Regional Conference on searching for and apprehending fugitives wanted by the ICTY,
BEARING IN MIND Article 3 of INTERPOL's Constitution, and Article 40 of the Implementing Rules for the Rules on the Processing of Information for the Purposes of International Police Co-operation concerning the interpretation of Article 3 in the context of the processing of information,
CONCERNED about the increase in the number of requests forwarded through INTERPOL channels concerning genocide, crimes against humanity and war crimes, which raise doubts as to their compliance with Article 3 of the Constitution, and the proliferation of disputes between member countries concerning the processing of such requests,
DECIDES, in light of the above that, in addition to the application of INTERPOL's general rules and regulations with regard to processing of requests for international police co-operation, the processing via INTERPOL channels of new requests concerning genocide, crimes against humanity and war crimes shall continue with regard to:
1. Requests submitted by international tribunals;
2. Requests submitted by entities established by the United Nations Security Council, subject to the specific arrangements agreed upon with regard to such requests;
3. Requests submitted by member countries, except in cases where the request concerns a national of another member country, and that other member country, upon being informed by the General Secretariat of the request, protests against the request within thirty days;
ENCOURAGES all member countries to continue their co-operation in the investigation and prosecution of perpetrators of genocide, crimes against humanity and war crimes using, inter alia, INTERPOL channels and in accordance with INTERPOL's rules and the present resolution;
ASKS the General Secretariat to continue to provide its assistance and to put in place the relevant procedures on the processing of requests in this area in accordance with the present resolution.
